
GENERAL OBLIGATIONS
Ticket holder and/or Purchaser use the Ticket(s) exclusively for their personal use.
Ticket holder and/or Purchaser of Tickets, whether individuals or represented by an entity, shall not:
- resell/exchange and/or attempt to resell/exchange and/or offer to resell/exchange the Tickets or transfer the obligations relating to the Tickets to third parties;
- use and/or attempt to use and/or offer to use all or some of the Tickets purchased for promotional or commercial purposes, particularly for competitions, lotteries, internal incentive operations and any other similar actions, or as part of a hospitality or travel package (for example combining flights, hotel and tickets) and/or more generally in any forms of visibility whatsoever;
- combine or seek to combine in any manner whatsoever his own name, the name of companies, groups, associations, etc., which he directly or indirectly controls and/or to which he is attached, or any one of the marks that he holds in this regard, with the names, marks and other intangible rights connected to the 6th Edition of the Rugby World Cup;
- and, more generally, cause harm in any manner whatsoever to the 6th Edition of the Rugby World Cup, the individuals and legal entities in any way connected with its organisation and the commercial partners.
In the event a Purchaser orders several Tickets within the limited number set out in Article 2, he shall ensure that the person(s) to whom he offers the ticket(s) (hereinafter "Recipient(s)") has/have fully acknowledged the present General Terms and Conditions and that the Recipient(s) fully agree(s) to and comply with these General Terms and Conditions. In particular, Purchaser shall pass on to the Recipient(s) a copy of these General Terms and Conditions.
Every ticket Holder shall be deemed to have agreed to the provision of these General Terms and Conditions and the Rules applicable to sporting events.
Orders
Tickets are ordered, in the form of a Package called “PACK” or individually, at the periods agreed via the Internet, or by telephone, or otherwise at the specific places established for sales, in France or abroad (referred to herein as the “Ticket Kiosks”).
Tickets can be ordered via the Internet at the following Internet addresses: www.france2007.fr - www.france2007.org - www.irb.com and any site listed by the Organising Committee of the 2007 Rugby World Cup.
When Tickets are ordered via the Internet, the Purchaser will have a right of retraction of seven clear days as from the date of the order was placed.
Any Purchaser wishing to implement his right of retraction must notify the Organising Committee of the 2007 Rugby World Cup by certified mail with acknowledgement of receipt.
Purchasers can also order Tickets at Ticket Kiosks. A list showing all the Ticket Kiosks with their full details is available at the following Internet addresses:
www.france2007.fr - www.france2007.org and, upon request, from the Organising Committee of the 2007 Rugby World Cup at the following address: Comité d’Organisation de la Coupe du Monde de Rugby 2007, 8 Esplanade de la Manufacture, 92130 ISSY-LES-MOULINEAUX.
In any event, the orders will be honoured without discrimination, in the chronological order of their placement and within the limited number of available seats.
The maximum number of Tickets that may be purchased per order and per Purchaser depends on the nature of the ticket and the identified category to which the Purchaser belongs.
The Organising Committee of the 2007 Rugby World Cup does not guarantee seats next to each other, unless they are placed under the same order number, limited to the maximum number of Tickets that may be purchased per order and provided that they belong to the same category, subject to number of seats still available.
The Tickets corresponding to the order will be sent by secured or traced delivery to the address provided by the Purchaser at the time of his order. The postage costs will be charged to the Purchaser.
Any change of address after the reservation has been sent shall be notified by registered letter with a copy of the identity card and a copy of documents proving former and new address.
Any order that has not been be delivered due to an incorrect address or the neglect of the person who placed the order will result in the termination of the sale, and the Organising Committee of the 2007 Rugby World Cup not having any obligation to reimburse.
No Tickets shall be collected from the Organising Committee of the 2007 Rugby World Cup.
Price and payment
The price of tickets and shipping costs mentioned on the various media accessible by Purchasers are indicated in euros and include all taxes.
The sale is firm and final once the payment has been collected, which constitutes acceptance of the order.
Payment will be made in a single transaction by credit card or by cheque made out to the official reseller.
In the event that the order for a Ticket is placed at a Ticket Kiosk, the payment may also be made in cash.
The sums paid are not deemed to be a deposit or a payment in advance.
In the event of theft or loss, the Tickets will neither be replaced nor reimbursed. Any ticket which defaced or forged will be deemed to be invalid and shall not be replaced nor reimbursed.
Access to the stadium
Access to the stadium is authorised only on presentation of a valid Ticket.
The general conditions of admission to the stadium which include the general obligations related to the admission conditions and the security measures can be consulted on the posters displayed outside the ground.
Ticket Holders agree to abide by the specific rules which may be established for a specific stadium.
No exit control cards will be issued. Any exit from the area of the stadium is final.
Any Ticket Holder attending a Match acknowledges that his behaviour around and inside the stadium are at his own risk.
The Organising Committee of the 2007 Rugby World Cup may not be held liable for the Ticket Holder’s failure to observe these specific rules.
The Organising Committee of the 2007 Rugby World Cup may be held liable for the damages (whether personal injury, material or others) that may be suffered by the Ticket Holder around and in the stadium (occurring before, during or after the Match), caused by gross negligence or intentionally by the Organising Committee.
Right to a person’s image
Any Ticket Holder attending a Match expressly acknowledges that it is a public event and in this regard agrees that his image may be broadcast for no consideration and more generally be exploited by any means and on any media, throughout the entire world and for the duration of the exploitation of the Match, and waives in advance all rights and actions seeking to oppose this exploitation.
Exploitation of the images and sound of the Match
All still or moving images shot by the Ticker Holder at the Match place may be exploited only for private use, excluding for any commercial, promotional or advertising purposes. Any other exploitation of these images is strictly prohibited.
The Ticket Holder’s exploitation of the broadcasts, comments, journalistic or statistical reports in particular (by any means, in any format and on any media, including mobile telephones and other wireless communication equipment) in connection with the Rugby World Cup 2007 Tournament is equally strictly prohibited.
Failure to abide by these General Terms and Conditions
Any Ticket Holder whose behaviour is incompatible with these General Terms and Conditions or whose Tickets were not obtained in accordance with these General Conditions of Sale, will have his order cancelled and/or will be refused entry to the stadium or will be escorted out of it.
In the event the Ticket Holder fails to observe the General Terms and Conditions, the Organising Committee of the 2007 Rugby World Cup shall have the right to cancel and/or require the return of Tickets and the Ticket Holder will not have any right to a reimbursement.
Liability
The Organising Committee of the 2007 Rugby World Cup may not be held liable, no claim will be admissible and no reimbursement will be made in the event of the cancellation or modification of the times, dates and/or places of one Match/the Matches of the 6th Edition of the Rugby World Cup as a result of a force majeure event.
Should the Organising Committee of the 2007 Rugby World Cup modify the time, date or place of a match due to circumstances other than force majeure, any Ticket Holder for the said match may, according to availability, make a claim for another ticket belonging to the same category as the original ticket for the postponed match.
Should a match of the 6th Edition of the Rugby World Cup be cancelled due to circumstances other than force majeure, the Organising Committee of the 2007 Rugby World Cup reserves the right to commence a procedure to obtain adequate and proportional compensation.
Under such circumstances, the amount of any claim may not exceed the price of the Ticket.
In any event, any claim made pursuant these General Terms and Conditions will only be admissible when it is made by Ticket Holders.
Communication of the General Terms and Conditions and information
These General Terms and Conditions are available at the following Internet addresses www.france2007.fr - www.france2007.org and, upon request, from the Organising Committee of the 2007 Rugby World Cup at the following address: Comité d’Organisation de la Coupe du Monde de Rugby 2007, 8 Esplanade de la Manufacture, 92130 ISSY-LES-MOULINEAUX.
Any request for information should be sent to the Organising Committee of the 2007 Rugby World Cup at the addresses mentioned in the preceding paragraph.
Processing of personal data
While processing personal data, the Organising Committee of the 2007 Rugby World Cup guarantees that it will comply with the Information Processing and Liberties law (Loi Informatique et Liberté) of 6 January 1978 and informs all Ticket Holders of their right of access to and rectification and withdrawal of the personal information provided to it as indicated above.
To ensure the safety of the public, the stadium can be equipped with a video surveillance system controlled by a law officer and capable of being used in criminal proceedings. A right of access is planned for pursuant to article 10-V of the law dated 21 January 1995.
Permanence of the General Terms and Conditions and amendments
In the event that any one of the provisions of these General Terms and Conditions is deemed to be partially or wholly invalid, illegal or unenforceable by a jurisdiction or any competent authority, pursuant to any applicable legislative or regulatory text, its total or partial inapplicability shall not affect the validity or enforceability of the other provisions of these General Terms and Conditions.
Within the limits of the applicable law, the Organising Committee of the 2007 Rugby World Cup reserves the right to make reasonable amendments to these General Terms and Conditions from time to time, which updated version shall be available on the official internet websites and at the address of the Organising Committee set out in article 9.
Valid and binding text
These General Terms and Conditions have been drawn up in the French language and translated into English language. In the event of a discrepancy between the French text and the English text, the French text shall be valid and binding to resolve any ambiguity in its interpretation and application.
Governing law and jurisdiction
These General Terms and Conditions shall be applied and interpreted in accordance with the legislation in force in France.
For any dispute that may arise in connection with the interpretation or performance hereof and more generally relate to these General Terms and Conditions, the Paris Courts shall have exclusive jurisdiction.
However, the Organising Committee of the 2007 Rugby World Cup reserves the right to undertake any legal measure before the courts of competent jurisdiction of the defendant’s domicile, or, when the defendant is not a consumer, before any other relevant jurisdiction.
